THE CLUB MEMBERSHIP Ts & Cs
1 INTRODUCTION
1.1 Welcome to The Couture Clubs Membership program. By becoming a member you agree to these Terms and Conditions.
1.2 The membership is free of charge and no purchase is necessary to become a member.
1.3 By being a member of the ‘The Club’ loyalty program you will earn points that qualify you for different tiers and unlock offers, exclusives gifts, events and much more organised by The Couture Club.
2 MEMBERSHIP
2.1 The membership is limited to individuals that are acting in a personal capacity and not in the capacity of a company, who have a current and valid email account and are at least 18 years of age, or from 16 years of age who have the consent of their parent(s), guardian or legal representative as applicable. The Couture Club reserves the right to request written confirmation of such consent.
2.2 By submitting your application, you confirm that you are at least 18 years of age, or 16 years of age and have the consent of your parent(s), guardian or legal representative as applicable, and that you agree to these Terms and Conditions.
2.3 Your Membership is personal, non-transferable and subject to these Terms and Conditions as well as any other rules, regulations, policies, and procedures adopted by The Couture Club as approved by you upon taking part of offers, rewards, making purchases and other related services. We apply a limit of one Membership per person.
2.4 It is your responsibility, and a condition for your membership, to keep your email and contact details up to date.
3 POINTS, TIERS AND VOUCHERS
3.1 The date when you become a member will constitute the “Start Date” of each “Membership Year”. The “Membership Year” is the 12 months following the Start Date of each year. The tier level of your membership is based on your spend during the current Membership Year. If you reach the Silver Tier or Gold Tier during a Membership Year you will stay at that membership tier level during the rest of the Membership Year. If you reach the Black Tier Membership tier level during the Membership Year, you will remain a black tier member for the following 12 months.
3.2 At the end of each Membership Year all points counting towards the next membership tier level will be reset and start over at 0.
3.3 Points counting towards vouchers are valid until the next Start Date.
3.4 All points have an arrival period of 15 days, this will appear as pending on your account until this period has passed.
3.5 When you have earned 100 points, a voucher of £5 will be issued in on you’re The Club account page in the form of points. You can redeem these points online against your purchase.
3.6 The voucher will be issued 30 days after the date of when the sufficient point balance was reached. You can only obtain 3 vouchers per calendar month, and a maximum of 20 vouchers every 12 month period.
3.7 Vouchers cannot be exchanged for cash or used for purchases with a total value that is lower than the value of the voucher
3.8 Vouchers cannot be used for purchasing The Couture Club Vouchers or Gift Cards.
3.9 The Membership year runs from 1st April to 31st March.
4 CHANGES, TERMINATION AND/OR REMOVAL FROM TCC'S LOYALTY PROGRAM
4.1 You may cancel your membership at any time through My Account at the website thecoutureclub.com website or by contacting our Customer Service. Please note that by cancelling your membership you will only be able to use the guest check-out option when shopping online.
4.2 If you cancel your membership any points left in your account will expire. In addition, any credit applications will be cancelled.
4.3 The Couture Club may, at its sole discretion, terminate, alter, limit, suspend or modify the ‘The Club’ Loyalty Program, and/or the Terms and Conditions at any time, in case of changes to applicable laws, changes in services provided by The Couture Club or introducing new services. Any such change will take effect after fourteen (14) business days from the date on which you have been informed of such change either in the app, online, via e-mail or a combination thereof. If you do not accept the changes you have the right to cancel your membership.
5 LIMITATION OF LIABILITY
5.1 The Couture Club will not be liable for any system failure or malfunction of the ‘The Club’ Loyalty Program or any consequences thereof. The Couture Club accepts no liability for any loss or damages arising from suspension, variation or termination or in any other way relating to the ‘The Club’ Loyalty Program, except for any liability which cannot be excluded by law.
6 APPLICABLE LAW AND JURISDICTION
6.1 These Terms & Conditions shall be governed by the laws of the United Kingdom, without regards to any rules or principles on conflicts of laws. Any dispute, claim or controversy arising or relating to these Terms and Conditions or membership shall be resolved by the applicable courts in the United Kingdom, unless otherwise stipulated in applicable mandatory consumer protection laws.
